Terms of Service

These Terms of Service ("Terms") govern your use of the AI model customization service "AI Rakuraku Ordermade" ("Service") operated by Tomoki Yasui ("Operator"). By using the Service, you agree to these Terms.

1. Scope of Application

• These Terms apply to all aspects of the relationship between the user and the Operator regarding the Service.
• Any additional guidelines or policies posted on the Service form part of these Terms.
• In case of conflict between these Terms and individual policies, the individual policies shall prevail.

2. Definitions

• "Service": The AI model fine-tuning service and all related features provided by the Operator.
• "User": Any individual or entity that registers for and uses the Service.
• "Training Data": URLs, text, PDFs, and other data provided by the User for model training.
• "Output": LoRA adapters and other AI model data generated by the Service.

3. Registration

1. Account registration is required to use the Service.
2. Users must provide accurate and up-to-date information during registration.
3. Each user is limited to one account.
4. Minors must obtain consent from a legal guardian before using the Service.
5. The Operator may refuse registration without disclosing reasons if false information is provided, the applicant has previously violated these Terms, or for other reasons deemed appropriate.

4. Pricing and Payment

1. Service fees are as follows (all prices include tax):
   • Standard Plan: ¥880 / $6 per run
   • Fast Plan: ¥1,430 / $10 per run
2. Payment is accepted via credit card through Stripe.
3. AI training begins after payment is confirmed.
4. The Operator may change pricing with prior notice. Changes will not affect already completed transactions.

5. Cancellation and Refunds

1. Users may cancel an order before payment is completed.
2. Once payment is completed, cancellations and refunds are not accepted regardless of the reason. The Service provides digital content (AI model training), and processing begins immediately upon payment. By placing an order, you acknowledge and agree to this policy.
3. As an exception, if training fails to complete due to a system error on the Operator's side, a full refund will be issued.
4. Refunds under the preceding clause are processed to the credit card used via Stripe and may take up to 10 business days.

6. Intellectual Property

1. Intellectual property rights in Training Data belong to the User or the rightful owner.
2. The right to use Output (LoRA adapters) belongs to the User. Users may use Output freely for commercial and non-commercial purposes.
3. Users warrant that they hold all necessary rights (copyright, licenses, etc.) to the Training Data they provide.
4. Intellectual property rights in the Service's software, UI, design, and logos belong to the Operator.
5. The Operator will not use Training Data for any purpose other than providing the Service.

7. Prohibited Activities

• Violating laws, regulations, or public order and morals
• Activities related to criminal conduct
• Providing Training Data that infringes on third-party copyrights, trademarks, privacy, or other rights
• Training on illegal, harmful, threatening, abusive, defamatory, obscene, or violent content
• Interfering with the Service's servers or network
• Unauthorized access or attempts thereof
• Collecting other users' information
• Transferring or lending accounts to third parties
• Decompiling or reverse-engineering the Service
• Any other activity deemed inappropriate by the Operator

8. Service Suspension

1. The Operator may suspend or interrupt the Service without prior notice for system maintenance, force majeure events, communication failures, or other reasons deemed necessary.
2. The Operator shall not be liable for any damage caused by suspension, except in cases of willful misconduct or gross negligence.

9. Warranty Limitations and Disclaimers

1. The Service is provided "as is." The Operator makes no warranties regarding safety, reliability, accuracy, completeness, fitness for a particular purpose, or non-infringement.
2. The Operator does not guarantee the quality, accuracy, or performance of Output. Users use Output at their own risk.
3. The Operator is not liable for damages arising from the content of Training Data.
4. The Operator is not liable for damages caused by GPU processing interruptions, delays, or unexpected output quality.
5. If the Operator is liable for damages, compensation shall be limited to the Service fee that directly caused the damage, except in cases of willful misconduct or gross negligence.

10. Account Restriction and Deletion

The Operator may restrict use or delete accounts without prior notice if a User violates these Terms, provides false registration information, or for other reasons deemed appropriate. The Operator is not obligated to disclose the reasons.

11. Withdrawal

1. Users may delete their account and withdraw at any time through the designated procedure.
2. Training Data and Output associated with the account will be deleted within 30 days of withdrawal. Please download any necessary data beforehand.
3. No refunds will be issued upon withdrawal.

12. Changes to Terms

The Operator may modify these Terms with prior notice. Modified Terms take effect upon posting on the Service. Continued use of the Service after modification constitutes acceptance of the modified Terms.

13. Personal Information

Handling of personal information is governed by our Privacy Policy.

14. Governing Law and Jurisdiction

1. These Terms shall be governed by the laws of Japan.
2. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
